1. Acceptance of Terms
By placing an order on this website, you agree to be bound by these Terms of Service together with all of the following policies: Shipping Policy, Return Policy, Refund Policy, Payment Policy, Privacy Policy, Contact Information, and About Us. These documents collectively form the entire agreement between you and the operator of this website.
If you do not agree to all of the terms stated in this document and the policies listed above, do not complete your purchase. No action other than completing a purchase constitutes acceptance.
2. Eligibility to Purchase
To place an order on this website, you must meet all of the following conditions:
- Be at least 18 years of age
- Have a valid shipping address within the 48 contiguous United States (as stated in the Shipping Policy)
- Own a valid Visa card, MasterCard, or PayPal account (as stated in the Payment Policy)
- Provide accurate, complete, and current billing and shipping information
We reserve the right to refuse service to anyone for any reason at any time, including but not limited to violation of these Terms.
3. Order Confirmation Is Not Acceptance of the Order
When you place an order, you receive an automated order confirmation email. This email is not a guarantee that your order will be fulfilled. It only confirms that we have received your order request.
We retain the right to cancel any order for any reason prior to shipment. Reasons for cancellation include but are not limited to:
- Suspected fraudulent payment
- Payment verification failure (including Address Verification Service mismatch as described in the Payment Policy)
- Inventory unavailability (item out of stock after order was placed)
- Pricing error (see Section 5 below)
- Suspected resale intent (more than 5 identical items in a single order)
If we cancel your order, we issue a full refund to your original payment method. You receive a cancellation email explaining the reason.
4. Pricing and Taxes
All prices displayed on product pages are in United States Dollars (USD) . Prices do not include sales tax unless explicitly stated.
For shipping addresses located in New York State, the appropriate sales tax is calculated at checkout and added to your total. This tax rate is determined by the county and municipality of the shipping address.
For shipping addresses located outside New York State, we do not collect sales tax because our business does not have physical presence (nexus) in those states. You may be required to report and pay use tax directly to your state tax authority.
We do not charge any additional fees beyond the product price and (for NY addresses) sales tax. Shipping is free as stated in the Shipping Policy.
5. Pricing Errors
Despite our efforts to ensure accurate pricing, errors may occasionally occur. If an item is listed at an incorrect price due to a typographical error, a data entry error, or a technical malfunction, we are not required to honor the incorrect price.
In the event of a pricing error, we will take one of the following actions:
- Cancel your order and issue a full refund to your original payment method, or
- Contact you to ask whether you wish to proceed with the order at the correct price
Refunds for cancelled orders due to pricing errors follow the same timing described in the Refund Policy (7 to 10 business days for credit cards, 3 to 5 business days for PayPal after we initiate the refund).
6. Product Descriptions and Availability
We attempt to display product descriptions, images, and specifications as accurately as possible. However, we do not warrant that product descriptions, images, colors, or other content are accurate, complete, reliable, current, or error-free.
Monitor displays and browser rendering vary. The actual color of a product as seen on your screen may differ from the physical product. Such differences do not qualify as a defect under the Return Policy.
Product availability is not guaranteed. If an item is in stock at the time you place your order but becomes unavailable before shipment, we will cancel the affected item from your order and refund the corresponding amount.
7. Prohibited Uses
You are prohibited from using this website or its content for any of the following purposes:
- Any unlawful activity under federal, state, or local laws
- Resale of products without our prior written permission
- Using robots, spiders, scrapers, or other automated means to access the website for competitive or commercial purposes
- Attempting to interfere with the proper functioning of the website (including introducing viruses, malware, or excessive requests)
- Submitting false, inaccurate, or misleading information during checkout
Violation of any prohibited use may result in immediate termination of your ability to place orders, forfeiture of any pending refunds (if the violation caused financial damage to us), and notification of appropriate authorities.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
Monetary Cap – Our total liability to you for any claim arising from or related to your purchase, whether based on contract, warranty, tort (including negligence), or any other legal theory, shall not exceed the amount you actually paid for the specific item that is the subject of the claim.
No Consequential Damages – We are not liable for any indirect, incidental, special, consequential, or punitive damages. Examples include but are not limited to: lost profits, lost savings, lost time, emotional distress, damage to other property, or the cost of substitute goods.
No Liability for Carrier Delays – We are not responsible for delivery delays, lost packages, or misdelivered packages caused by USPS, UPS, FedEx, or any other carrier, except where the carrier’s tracking system shows the package never left our facility. Our responsibility ends when the carrier scans the package as “Accepted” at our drop-off location.
No Liability for Bank Delays – We are not responsible for delays in refund availability caused by your bank, credit card issuer, or PayPal. Refund timing after we initiate the refund is controlled solely by your financial institution, as stated in the Refund Policy.
9. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (hurricanes, earthquakes, floods, wildfires)
- Postal or shipping service interruptions (strikes, labor disputes, carrier bankruptcies)
- Pandemics, epidemics, or public health emergencies
- Government actions (new regulations, border closures, import/export restrictions)
- Cyber attacks, server outages, or payment gateway failures
If a force majeure event occurs, we will make reasonable efforts to notify you via the email address you provided. We will resume performance as soon as the event is resolved. If the force majeure event continues for more than 30 days, either party may cancel the order, and we will issue a full refund for any unshipped items.
10. Modification of These Terms
We may update these Terms of Service at any time without prior individual notice. The “Last Updated” date at the top of this page indicates when the most recent changes were made.
The version of these Terms that applies to your order is the version that was posted on this website on the date you placed your order. Any changes made after your order date do not apply retroactively to your order.
It is your responsibility to review these Terms before each purchase. Continued use of this website after changes are posted does not constitute acceptance of the new terms for past orders, but does constitute acceptance for future orders.
11. Governing Law
These Terms of Service and any dispute arising from or related to your purchase, your use of this website, or any policy referenced herein are governed by the laws of the State of New York, without regard to its conflict of law principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
12. Dispute Resolution and Venue
Informal Resolution Required First – Before filing any legal claim or initiating any formal dispute resolution proceeding, you agree to contact us at the email address listed in the Contact Information policy. You must describe the nature of your dispute and propose a resolution. We will respond within 30 calendar days. If the dispute is resolved during this informal period, no further action is required.
Exclusive Venue – If the dispute cannot be resolved informally within 30 days, the exclusive venue for any legal action shall be:
- The Small Claims Court of Rockland County, New York, if the amount in controversy is within that court’s jurisdictional limit (currently $5,000 or less), or
- The State Court located in Rockland County, New York (the 9th Judicial District) for all other claims
You agree not to file any action in federal court unless the amount in controversy exceeds the small claims limit and federal jurisdiction exists. You also agree not to file any action in any court outside Rockland County, New York.
No Class Actions – All disputes between you and us shall be resolved on an individual basis. You agree not to bring or participate in any class action, consolidated action, or representative action against us. If this class action waiver is found to be unenforceable, then the entirety of this dispute resolution section (Section 12) shall be null and void.
13. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent possible, or if not possible, shall be severed from these Terms. The remaining provisions shall remain in full force and effect.
14. No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of this business. A waiver with respect to one incident does not apply to any past or future incidents.

Notices sent by regular mail or email do not satisfy legal notice requirements unless specifically stated otherwise in these Terms.
16. Entire Agreement
These Terms of Service, together with the Shipping Policy, Return Policy, Refund Policy, Payment Policy, Privacy Policy, Contact Information, and About Us, constitute the entire and exclusive agreement between you and the operator of this website. They supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, relating to your purchase.
Any terms or conditions appearing on a purchase order, invoice, or other document issued by you that are different from or in addition to these Terms are hereby rejected.
